Sidang dakwaan kasus korupsi tambang batu bara Samin Tan (Kurniawan/detikcom)

Jakarta -

Terdakwa kasus dugaan korupsi pengelolaan pertambangan PT Asmin Koalindo Tuhup (PT AKT), Samin Tan, didakwa oleh jaksa penuntut umum telah merugikan negara Rp 17,7 triliun. Jaksa mengatakan kerugian ini timbul dari aktivitas penambangan, pengangkutan, dan penjualan batu bara hasil penambangan dalam kawasan hutan pada wilayah tambang PT AKT secara ilegal.

Sidang pembacaan surat dakwaan terhadap Samin Tan dibacakan jaksa dalam sidang yang digelar di Pengadilan Tipikor Jakarta, Kamis (5/11/2026). Jaksa menyampaikan Samin Tan melakukan aktivitas penambangan, pengangkutan, dan penjualan batubara meski Perjanjian Karya Pengusahaan Pertambangan Batubara (PKP2B) milik perusahaannya, PT AKT, telah diterminasi (diakhiri) berdasarkan Keputusan Menteri Energi dan Sumber Daya Mineral Nomor: 3714 K/30/MEM/2017 pada tanggal 19 Oktober 2017.

"Merugikan keuangan negara sebesar Rp 17.745.627.652.570,30 sebagaimana laporan hasil audit penghitungan kerugian keuangan negara atas perkara dugaan tindak pidana korupsi penyimpangan dalam pengelolaan pertambangan PT Asmin Koalindo Tuhup (AKT) di Kabupaten Murung Raya Kalimantan Tengah pada tahun 2016 sampai dengan tahun 2025," ungkap jaksa.

Jaksa mengatakan Samin Tan merupakan Pemilik Manfaat (Beneficial Owner) dari sembilan perusahaan induk di bidang pertambangan. Dari aktivitas penambangan, pengangkutan dan penjualan batu bara perusahaan-perusahaan tersebut, Samin Tan meraup untung hingga Rp 17,7 triliun.

Selain Samin Tan, keuntungan dari aktivitas penambangan, pengangkutan, dan penjualan batu bara secara ilegal ini turut memberikan keuntungan untuk 13 pihak di Kantor Unit Penyelenggara Pelabuhan (KUKSO atau Kantor Kesyahbandaraan dan Otoritas Pelabuhan (KSOP) Rangga Ilung sebesar Rp 3,9 miliar serta Muhammad Juni Eka Wardhana selaku Komisaris Utama PT. Cordelia Bara Utama senilai Rp Rp 170 miliar

"Telah turut serta melakukan tindak pidana dengan tujuan menguntungkan diri sendiri atau orang lain atau suatu korporasi," terang jaksa.

Samin Tan didakwa melanggar Pasal 603 Juncto Pasal 20 huruf c Undang Undang Nomor 1 Tahun 2023 tentang Kitab Undang-Undang Hukum Pidana Juncto Pasal 18 Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi. Dia juga didakwa melanggar Pasal 3 Juncto Pasal 18 Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi Juncto Pasal 20 huruf c Juncto Pasal 3 ayat (1) Undang-Undang Nomor 1 Tahun 2023 tentang Kitab Undang-Undang Hukum Pidana.
