Liputan6.com, Jakarta - Pekerja atau buruh kini mendapatkan kepastian mengenai hak cuti tahunan dan pelaksanaan cuti bersama melalui Undang-Undang Nomor 27 Tahun 2026 tentang Pelindungan Ketenagakerjaan.

Dalam Pasal 118, pemberi kerja diwajibkan memberikan waktu istirahat dan cuti kepada pekerja. Salah satu ketentuan yang menjadi perhatian adalah pelaksanaan cuti bersama yang ditetapkan pemerintah pusat tidak mengurangi hak cuti tahunan pekerja.

Artinya, apabila perusahaan menerapkan cuti bersama yang ditetapkan pemerintah pusat, jatah cuti tahunan pekerja tidak boleh dipotong karena pelaksanaan cuti bersama tersebut.

Dikutip dari aturan tersebut, Sabtu (7/11/2026), ketentuan ini memberikan kepastian bagi pekerja agar hak cuti tahunan tetap dapat digunakan sesuai kebutuhan.

Pasal 118 ayat (5) menyebutkan pekerja berhak memperoleh cuti tahunan paling sedikit 12 hari kerja setelah bekerja selama 12 bulan secara terus-menerus.

Selain cuti tahunan, UU juga mengatur hak istirahat di sela-sela jam kerja. Pekerja harus mendapatkan waktu istirahat paling sedikit 30 menit setelah bekerja selama empat jam terus-menerus. Waktu istirahat tersebut tidak dihitung sebagai jam kerja.

Untuk istirahat mingguan, pekerja yang menjalankan enam hari kerja dalam satu minggu berhak memperoleh satu hari istirahat. Sementara itu, pekerja dengan lima hari kerja dalam satu minggu berhak atas dua hari istirahat mingguan.

Hak Istirahat Panjang

UU ini juga mengatur hak istirahat panjang selama 30 hari kalender setelah pekerja bekerja secara terus-menerus selama lima tahun atau kelipatannya.

Menariknya, penggunaan waktu istirahat sebagaimana diatur dalam pasal tersebut tidak mengurangi hak pekerja atas upah dan manfaat lainnya. Namun, terdapat ketentuan khusus bagi pekerja yang mengambil istirahat panjang. Mereka tidak berhak atas cuti tahunan pada tahun berjalan.

Sementara itu, pelaksanaan cuti tahunan tetap diatur lebih lanjut dalam perjanjian kerja, peraturan perusahaan, atau perjanjian kerja bersama. Dengan demikian, perusahaan perlu menyesuaikan ketentuan internalnya dengan hak minimum yang telah ditetapkan dalam UU.
